Inside Michigan Family Law: Max Emmer Talks Spousal Support, Custody & Client Advocacy

In a candid and insightful episode of The Attorney Post, Michigan-based attorney Max Emmer joins the conversation to share his perspectives on modern family law, the evolving dynamics of custody cases, and how his client-focused approach is transforming the divorce experience. With 13 years of legal experience and four years of running his own firm, Emmer offers both professional wisdom and deeply personal insights into one of the most emotionally complex areas of law.

A Path Rooted in Empathy and Realism

Max Emmer’s journey into family law was far from linear. Initially practicing in various legal fields, Emmer found his true calling in family law due to its emotional depth and long-term impact on clients' lives. His firm, founded during the summer of 2021, was launched under unique circumstances—during a pandemic and while his wife was eight months pregnant. Starting without clients or a marketing budget, Emmer built his practice from the ground up.

This origin story reflects Emmer’s broader philosophy: relationships matter more than volume. Rather than running a high-volume operation, he intentionally caps his active client list at 12 to 13 families to ensure personalized service and accessible legal guidance.

Transforming Divorce into a Collaborative Process

Unlike the adversarial mindset many associate with divorce, Emmer champions amicable solutions. Approximately one-third of his caseload is collaborative divorce, another third comprises mediation and one-lawyer representation, and the rest includes traditional litigation when necessary. This division shows his preference for cooperative legal solutions when possible.

He also addresses a common misconception in custody cases—that the courts are inherently biased toward mothers. Emmer explains that custody arrangements today generally reflect more balanced parenting structures, such as 50/50 or 49/51 time splits. However, outdated perceptions still exist among clients, particularly from older generations.

Realistic Expectations and Emotional Insight

One standout aspect of Emmer’s practice is his commitment to managing client expectations. He frequently encounters unrealistic demands, such as clients requesting custody for 13 out of 14 nights. In such instances, Emmer provides grounded, honest feedback, rooted in Michigan’s child support formula and parenting time guidelines.

He also recounts absurd yet revealing cases, including a dispute during mediation over a George Foreman grill and a near-physical altercation between elderly spouses. These anecdotes reveal the emotional weight and unpredictability of family law, often hidden beneath legal jargon and paperwork.

Embracing Technology and Limited Scope Representation

As a product of the pandemic era, Emmer’s firm was born into a digital legal landscape. He notes that even five years into virtual hearings, many attorneys still struggle with platforms like Zoom. This shift has prompted Emmer to adopt limited scope representation, a more flexible and affordable approach introduced in Michigan in 2019. It allows clients to get essential legal guidance without committing to expensive retainers.

Social Shifts and Generational Change

Emmer observes that younger generations are approaching marriage and divorce differently. With higher levels of debt and financial instability, many millennials and Gen Z clients seek resolution rather than confrontation. Emmer’s firm has responded by offering services like prenuptial agreements (he drafted 16 last year alone) and same-sex divorce representation with the same legal rigor applied to heterosexual couples.

Spousal support, another evolving topic, is no longer seen as permanent in Michigan. In marriages under five years, it’s often not awarded at all. For longer marriages, it might last for a third of the marriage’s duration—again, subject to negotiation.

A Practice Built on Integrity

Above all, Emmer emphasizes that legal practice is also customer service. Many attorneys, he believes, overlook this reality. By staying selective with his caseload and open to limited-scope services, Emmer has cultivated a firm that puts people before profits. He also acknowledges the value of legal aid organizations for those unable to afford representation, reflecting his belief that justice should be accessible.

In his closing thoughts, Emmer challenges listeners with three powerful questions: What would you change about your legal practice? What advice would you give your younger self? And what law would you rewrite? These questions encapsulate a lawyer who is not only thoughtful and driven—but deeply human.
